Man Sues Wataburger for $1M Over Onion Allergy

A man from Houston has sued the "Wataburger" restaurant chain, demanding compensation of up to one million dollars, claiming the restaurant left onion in his burger despite his request to remove it due to a food allergy. Demeer Wilson filed the lawsuit against the Texas-based chain at the end of last month in Harris County. The lawsuit alleges he "suffered serious personal injuries that required medical attention." In its response, "Wataburger" claims Wilson did not exercise "the care that a reasonable person would" under similar circumstances. According to the "Houston Media" website, this is not the first time Wilson has sued a fast-food chain over onion in his sandwich. In May 2024, he sued Sonic Drive-In, alleging they left onion in a sandwich he ordered in April 2023. According to court documents, Sonic denies these allegations, and the case is still pending. In the latest lawsuit, Wilson and Wataburger are seeking damages, as well as reimbursement for his attorney's fees. Wilson claims he suffered an allergic reaction on July 24, 2024, "due to the onion in his meal after he requested it not be added." The lawsuit, which seeks damages ranging from $250,000 to $1 million, alleges that "Wataburger" failed to act appropriately and should have been aware "of the danger of its actions." "Wataburger" filed its response last Friday, denying all of Wilson's claims.
